Officers went to the location they were given where Malone was possibly staying in the Woodhaven neighborhood. The location was 6065 Stoneybrook #6065 which is just south from the intersection of 5900 Oakland Hills Drive and 5900 Boca Raton Boulevard. Officers entered the apartment complex and parked in their undercover vehicle in a location where they could monitor the apartment. Malone Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- exited the apartment just after 5:00 p.m. and walked through the parking lot toward Oakland Hills Drive. Malone continued walking north toward Boca Raton Boulevard where he met up with an individual later identified as his brother at the Diamond Mini Mart which is located on the southeast corner of Oakland Hills and Boca Raton. Officers followed him in the undercover vehicle and then parked north of the business and continued to monitor Malone. The team had several other officers from their team standing by in marked patrol vehicles. They were to make contact with Malone to conduct a consensual encounter in hopes of having him agree to voluntarily talk with the homicide detectives. After a short time, officers inside the undercover truck observed what they believed to be the butt end of the magazine from a handgun in Malones athletic shorts. The shorts were sagging as if there were something heavy in his pocket. Because there was a large group of individuals gathered loitering in the same area where Malone was standing, officers made the decision to wait until most had dispersed before making contact with Malone. The officers advised the marked unit officers that they were ready to move in and make contact with Malone and told them they believed he was armed with a handgun concealed in his pants. A marked unit approached from the south and entered the store parking lot and the undercover truck approached from the north. The officer in the marked patrol vehicle opened his drivers door and called out to Malone, "Hey, can I talk to you for a minute?". Malone was walking south down the covered sidewalk next to the east side of the store. The minute the officers approached, Malone turned toward street and ran. Several officers began to chase Malone and as he ran he pulled a handgun from his right pocket with his left hand. Officers yelled, "Gun. Gun. Gun.". Four officers were pursuing Malone and as he entered Oakland Hills Drive, Malone turned his upper body toward the left and pointed the handgun directly back toward the officers. All four officers fired at Malone; two officers in their statements believed that he fired his handgun at them. (ballistics are not back yet to confirm). Malone continued to run southwest across the street still pointing the handgun at the officers. Officers fired the handguns several more times. Malone fell to the ground on the west side of the street in the grassy area between the street and the sidewalk. Officers approached and were able to get him handcuffed. A Taurus 24/7 .45 caliber handgun was located near Malone in the grass. Officers located a gunshot wound on Malone's upper left back just to the left of his spine. Officers requested MedStar ambulance make the scene and they provided medical treatment until the medical personnel arrived on the scene. Malone was transported to Harris Methodist Hospital where he was pronounced deceased a short time later. Custodial Death Report :: Page 7 of 7
