The decedent reportedly drove to the location and kicked in the front door of the residence. After making entry, the decedent began assaulting the complainant, her husband, and one of their children. As the incident continued, the decedent proceeded to shove a white powdery substance (later determined to be Diatomaceous Earth) in each of their faces making statements about aliens and getting the worms out of them as he spread the powder throughout the home. A Bexar County Sherriff's Office Deputy, was the first officer to arrive on scene. Upon the deputy’s arrival, he made contact with the decedent in the street, in front of the residence located at 8702 Versant Bluff. The decedent immediately approached and physically assaulted the deputy, ignoring verbal commands to turn around and place his hands behind his back. The decedent refused to comply with the deputy’s commands and proceeded to attempt to grab hold of the deputy. With his Taser drawn, the deputy defended against the decedent‘s attempt to grab hold of him and warned the decedent he would be tased if he did not comply with his (the deputy’s) verbal orders. The decedent continued to disregard the deputy’s verbal commands, stating to the deputy “I will fuck you up” as he (the decedent) began walking away towards his sister, the complainant who was standing near the front entryway of the residence. Seeing her brother, the decedent, approach her, the complainant told the decedent to stop and that he was not going to go near her children. As the complainant pleaded with the decedent to stop, he continued to advance towards her. The deputy fired his Taser striking the decedent. As the Taser cycled, the decedent fell to the ground, deployed a knife, and began stabbing at the deputy. The decedent immediately jumped back up and aggressively charged at the deputy slashing at the deputy with the knife. At this time, the deputy, who had been struck in the face and torso by the knife, fired his service weapon at the decedent. The decedent, who had been shot by the deputy, collapsed onto the roadway and was handcuffed. The decedent was pronounced deceased at 7:37 AM; the deputy was transported to the hospital with multiple injuries. Custodial Death Report :: Page 7 of 7
