Under Restraint: No Summary of Incident Summary of How the Death Occurred: (max. 30,000 characters) Summary: Two officers were riding double in a marked police vehicle while wearing a full police uniform. At approximately midnight, they attempted to detain a male individual riding a bicycle, but he refused to stop. Officers pursued the individual as he fled westbound on Pima St, cutting off his escape in front of 206 Pima. After exiting the driver's seat, the first officer contacted the actor on the driver's side of the police vehicle where he attempted to take him into custody. A struggle ensued as the male reached for his waist line while still straddling the bicycle. The first officer told the actor "don't reach, don't reach." The second officer had Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- exited the passenger seat and had made his away around the police vehicle and he began to provide assistance as the actor and first officer struggled. While all were struggling, the three fell to the ground. It was at this point that officers realized the actor was in possession of a handgun which had been concealed along his waistline. The first officer began to verbalize "he's got a gun" as the actor continued to resist officers' efforts, actively trying to maintain control of the pistol being held in his hand. Fearing they were about to be shot, both officers created space and fired at the actor striking him multiple times. The actor died at the scene as a result of his injuries. The investigation found the actor committed acts supporting a charge of Aggravated Assault against a Public Servant. Custodial Death Report :: Page 7 of 7
