Under Restraint: No Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- Summary of Incident Summary of How the Death Occurred: (max. 30,000 characters) Summary: At 12:33 pm on January 8, 2019, Midland County Sheriff's Office received a 911 call reference a disturbance involving a hammer and a head injury East of Midland off of Business 20 and County Road 140. Other people called in reporting that a male subject was walking in the roadway in the eastbound traffic and had been struck by a vehicle mirror but was up and getting on the railroad tracks. The subject appeared to be cutting himself with something and was walking in the middle of the railroad track. Some subjects were trying to get him off the track and were behind him trying to talk to him but he was not paying any attention to them. A Patrol Deputy arrived and tried to talk to the subject but was not having any luck. The Deputy deployed a taser twice but it did not phase the subject, the subject turned around and lunged at the Deputy with a broken bottle, the Deputy fired two rounds and the subject fell on the tracks. A train was heading Eastbound and the Deputy had to pull the subject off the tracks to keep him from getting injured and discovered the subject was deceased. The Texas Rangers have been asked to conduct the investigation into the officer involved shooting. Custodial Death Report :: Page 7 of 7
