Summary:
On 01/02/109 at approximately 1407 hours San Antonio UEDI Mireles # 2548 responded to Loop 410 NE
near the Austin Hwy ramp for a gray stalled vehicle. The caller reported the person with the stalled vehicle
seemed suspicious and was removing the license plates from the vehicle.
When Mireles arrived he located a gray 2019 Cadillac that appeared to be stuck in the mud in the grassy area
between the main lanes and the ramp to Austin Hwy. Mireles exited his patrol vehicle and approached the
vehicle. The weather was cold and raining and he could not determine if the vehicle was occupied. Mireles
went to the passenger side of the vehicle and knocked on the window. Mireles reported that he heard the
vehicle’s doors unlock and he opened the passenger door so he could see inside the vehicle. The actor
quickly exited the driver’s side of the vehicle when Mireles opened the passenger door. Mireles stated the
actor turned towards his direction and seemed to be very nervous and not acting normal. The actor said
something about the vehicle having flat tires. Mireles said it appeared the actor was under the influence of
narcotics and kept trying to get back inside the vehicle. He said he kept talking to the actor was asking him to
come towards him and the roadway to get out of the mud they were standing in. Mireles continued talking to
the actor until Officer Garcia arrived at the location. With Garcia’s assistance they were able to get the actor
to start walking towards Mireles’s patrol vehicle. Mireles stated the actor paused and picked up a metal pipe
and he asked him to put it down. The actor put the pipe down and walked over to Mireles’s patrol vehicle.
Officer Garcia asked the actor for identification and he stated he did not have any. Mireles stated he decided
to handcuff the actor for their safety, due to his erratic behavior and until they could determine if the vehicle
was stolen and the identity of the actor. When Mireles and Garcia started to place the actor in handcuffs the
actor began resisting them. The actor was able to get his arms in front of his body and continued to physically
resist Mireles and Garcia. Both officers were giving verbal commands to the actor to stop resisting. As they
struggled with the actor and due to their proximity to the roadway Mireles deployed his Taser. Mireles tased
the actor and he began to fall to the ground. Mireles was on his knees and was attempting to gain control of
the actor when the actor was able to gain control of Mireles’s Taser. The actor used the Taser on Mireles and
was able to tase him in the leg. Mireles and Garcia continued to struggle with the actor. Mireles stated the
actor reached towards his waistband with his free hand and fearing that the actor was reaching for a weapon
he fired three rounds from his service weapon. The actor was struck three times in the chest. Mireles and
Garcia were able to handcuff the actor and as they rolled him to his side Mireles observed a knife on the
pavement near the actor.
