The pursuing officers were operating marked Houston Police vehicles with lights and sirens activated and were dressed in official Houston Police uniforms. As one of the pursuing officers neared, the decedent brandished a handgun and cycled the slide. Underwood attempted to turned and fell causing him to land prone with his arms outstretched above his shoulders. The officer gave verbal commands for Underwood not to move, however Underwood refused to comply with the commands, and he moved his right hand under his torso. A struggle ensued between the officer and Underwood, and Underwood's right hand emerged from under his right shoulder holding a black-in-color semiautomatic handgun. The officer, fearing for his own safety and those around him, fired his weapon striking the decedent one time. Life-savings measures were taken by officers in the area and Underwood was transported to a local hospital where he was treated for his injuries. On the date of the incident, charges were filed for Aggravated Assault Against a Public Servant, Unlawful Carry of a Weapon with a Felony Conviction, and Evading Arret/Detention in a Motor Vehicle.
