Summary of Incident
Summary of How the Death Occurred: (max. 30,000 characters)
Summary:
On 10/17/2023 at approximately 0456 hours, two SAPD officers riding together in one patrol vehicle observed
a suspect vehicle in the 500 Block of W. Cevallos. As the officers observed this vehicle, they developed
probable cause for a traffic stop. The officers followed the vehicle until it turned eastbound on Colima and
then initiated a traffic stop by activating the patrol vehicle’s emergency equipment. The suspect vehicle
continued to travel at a slow rate of speed until it eventually turned into a residential neighborhood. As the
suspect vehicle came to a stop, both the driver and passenger fled on foot from the vehicle. One SAPD officer
pursued the female driver and was able to apprehend her after a brief chase. However, the male passenger
(the decedent) from the suspect vehicle fled on foot and continued to run from a SAPD officer who was giving
commands for the decedent to stop. As the officer pursued the decedent he observed the decedent to be
carrying a handgun. The officer shouted “gun” as well as broadcast over police radio that the decedent was
armed with a handgun. Additional officers arrived in the area as the decedent continued to evade officers on
foot. Other arriving officers also observed the decedent to have a handgun in his hand. The decedent ran to a
residence on Gus Garcia and appeared to enter the back yard, however, an uniformed SAPD officer was near

this yard and yelled for the decedent to stop and drop the weapon. Another officer in the front of the residence
then observed the decedent turn and raise the gun towards him. This officer, as well as a second officer, then
fired their service weapons at the decedent. The decedent was struck several times. EMS arrived and
pronounced the decedent deceased at the scene.
