The caller stated that he was either intoxicated or mentally unstable and she wanted him to leave her residence. Deputies spoke with Haywood inside of the residence Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- and then moved to outside where he was offered a ride home by the original 911 caller. Haywood did not want to leave with her but agreed to allow deputies to drive him home. He was transported without restraints to the area of his home near the intersection of Texas Avenue and US Hwy 82 in New Boston, TX. Haywood refused to exit the patrol unit and began exhibiting erratic behavior. Haywood damaged the unit by breaking the inside door handle in efforts to prevent his removal from the unit. He was subsequently arrested for that offense. Due to his behavior, the patrol supervisor advised to transport him to the Bi State Jail without restraints, in efforts of avoiding use of force to restrain him. Haywood became more excited during the transport and attempted to exit the moving patrol unit en route to the jail. Deputy Zach Kennington stopped at I-30 @ Spur 74 and law enforcement had to remove Haywood from the unit and place hand and leg restraints on him. He resisted the restraint but minimal control tactics were used to accomplish placement of both sets of restraints. He was placed back into the unit where he was in a seated, upright position with hands restrained behind his back. Haywood had to be taken from the unit at the jail as he passively resisted efforts to bring him inside (refused to exit the unit, refused to walk/stand upon exiting the unit). Haywood was escorted to the jail by LaSalle Corrections (privately contracted jail operator) Officers along with BCSO Lt. Curtis Cole and Deputy Zach Kennington. Upon entry of the jail, Bowie County Sherifff's Deputies exited the facility and left Haywood in the care of LaSalle Corrections Officers (Lt. Hopkins and C.O. Morrison) within the Bi State Jail. In-house jail video depicted Haywood's erratic behavior that appeared to be the result of an intoxicant. He was escorted to the holding cell where Corrections Officers attempted to change him into jail clothing. The video depicted Lt. Hopkins strike Haywood one time with his knee as Haywood passively resisted on the floor. The strike appeared to be on the back of the neck or head but resulted in no visible injuries. Haywood was changed into jail issued pants and escorted to cell K-4. He continued to passively resist but was ultimately placed into the cell without further incident. Haywood was found unresponsive in the cell (K-4) a short time later. Life Net Ambulance Service was called for at 5:06 am. Jail and ambulance staff were unable to resuscitate Haywood. He was pronounced deceased at 5:45am by JP Nancey Talley. The Bowie County Sheriff's Office notified TX Ranger Josh Mason and requested his assistance in investigating Haywood's death. Haywood was transported to the Southwestern Institute of Forensic Sciences at Dallas for an autopsy. The results are pending. Custodial Death Report :: Page 7 of 7
