Summary of Incident
Summary of How the Death Occurred: (max. 30,000 characters)
Summary:
INVESTIGATION:
On 07-16-2019 at approximately 0034 hours Deputy Yates initiated a traffic stop in the area of CR 687 and
SH 288B Angleton TX 77515. At approximately 0034 hours Deputy Yates advised over BCSO dispatch radio
channel that shots were fired, and I was dispatched to assist.
Upon Deputy Yates advising that shots were fired I further head Deputy Yates come across the radio again
that the driver of the vehicle had ran from the car, but could not understand exactly where the driver had ran
to. I was responding from the south end sub station when I heard Deputy Yates come over the radio again
stating that there was more shots fired by the driver, and that Richwood PD had the passenger of the vehicle
detained.
I arrived at approximately 0041 hours and observed Deputy Yates to be standing behind a Richwood PD
patrol unit on the roadway infront of the address 252 CR 687 Angleton TX 77515. Deputy Yates at this time
was accompanied by Richwood Officers Mayfield and Skelton and had taken cover behind the Richwood
Explorer and Crown Vic patrol units and observed a white male in a red shirt with blue jeans to be laying in
the ditch to the south side of the road in hand cuffs. I later learned that the male in the ditch was the
passenger Joshua Huber, and was not involved in the shooting that had occurred.
As I arrived on scene I requested Officer Skelton cover me while I access the trunk section of the BCSO 1542
patrol unit to access the Brazoria County Issued AR 15 platform long rifle. As I was getting the rifle from the
case and loading, Deputies Johnson and Cleberg arrived on scene with Angleton PD Officer Pennington and
Corporal Vandergrift behind them, and shortly after Sgt. Crawley from Oyster Creek PD. I had positioned the
1542 patrol unit facing west on CR 687 and was covering the south of the residence which covered the side

of the garage which was at the west portion of the house, several windows the front door which was
positioned towards the middle of the south wall of the house and opening to the west, to the east corner of the
residence to an open side yard.
It was last known for the driver who was shooting at Deputy Yates and identified by Joshua Huber as
Brandon Stansel to be entering the garage portion of the residence. The garage was a double bay door style
opening that faced west as the drive way curved into the garage so with our current positioning behind cover
of the patrol units, we were unable to see inside the garage. Deputy Johnson and Officer Pennington left
cover of the patrol units on the street and went around the east corner of the residence opposite side of the
garage and took place on the north side of the residence to surround the residence.
Joshua Huber had advised that Brandon Stansel had been hit by Deputy Yates in the first shooting altercation
between Deputy Yates and Brandon Stansel, but was unsure of where on his body he was hit. Joshua Huber
stated that Brandon Stansel was "bleeding all over the place". I made several attempts calling out for Brandon
Stansel to answer but could not get a response, and could never see any movement from inside the
residence windows or from the garage area.
While we were on the street awaiting some type of response from Brandon Stansel, BCSO Dispatch had
advised that the brother of Brandon Stansel had called in advising that he received a call from the Father of
Brandon Stansel who was inside the residence that Kelly Brumley had been shot as well as Brandon Stansel
and both were in the garage, and that the father had no part in the shooting. As Sgt Staner arrived he advised
BCSO Dispatch to call out Swat and a negotiator. Sometime as Sgt. Staner arrived Deputy Shane had arrived
as well and was coming east bound on CR 687. Deputy Yates had advised Deputy Shane to position herself
on the roadway at a point where she could get a better sight into the garage. Deputy Yates asked Deputy
Shane if she could see inside the garage and Deputy Shane advised that she could see the open garage
door but could not see a male or female anywhere in the garage.
While we were waiting, I observed the front door open to the residence and called out to the units on scene
that we had movement at the front door, and then advised over the radio that there was movement at the
front door. I observed a white male to emerge from the door with his hands in the air, and Deputy Yates
began calling commands to the white male to keep his hands in the air facing the house and to walk
backwards through the front yard towards the street. As Deputy Yates was calling commands I observed the
white male later identified as the father of Brandon Stansel to be following commands so I took point at the
Richwood PD explorer which was positioned closest to the driveway and kept focus on the garage area of the
house for any movement. Sometime while I was covering the garage area of the residence Corporal
Vandergrift had made his way to where I was positioned and we both observed the neighbors to the west of
the residence to have opened the front door of their home and had partially emerged from the front door.
Corral Vandergrift ran west on the road to the front of the neighboring house and to the front door where he
met up with the neighbors and got them to go back inside their residence for cover as we were still unsure of
the status of Brandon Stansel. Corral Vandergrift was able to enter the neighbors residence and accessed
one of the north rooms of the house where a window was facing the open garage. Corral Vandergrift advised
over BCSO dispatch 1 radio that he could see a female laying in the driveway infront of the garage with what
he believed to be a gun shot wound and was not moving.
As Corporal Vandergrift emerged from the neighbors residence, he took cover behind a tree in the front yard
of the neighbors residence. I observed Deputy Yates join Corporal Vandergrift at his point of cover and
observed the two speaking, but could not hear what they were saying. A few seconds after Deputy Yates and
Corporal Vandergrift spoke, I observed the two begin to advance towards the garage where Brandon Stansel
was last seen and where the female was seen laying on the ground. As I observed the two advancing I left
my point of cover as well and began advancing down the driveway to the garage along with Deputy Shane,
Officer Mayfield and Officer Skelton. As we got closer to the garage I observed the female to be laying lifeless
on the ground and saw Deputy Johnson and Officer Pennington to be yelling commands toward the vehicle
that Deputy Yates had stopped in the driveway. As everyone turned their attention to the vehicle I observed
Brandon Stansel to be slouched backwards from the driver seat to the passenger seat and had drawn down
with the county issues rifle that I was still in possession of. I observed Brandon Stansel to not be responding
to commands at all and upon further observation appeared to not be breathing as I was looking through the
rear driver side passenger window. I remained in my position until one of the Deputies or Officers secured an
unknown handgun from Brandon Stansel, and placed it on top of the car.
After the weapon was secured I turned my attention back to the garage area since we were still uncertain if
the inside of the garage or inside of the house was secured, and remained until myself Deputy Shane and
some of the Officers on scene (unsure of which ones) cleared the garage and the inside of the residence. As I
was making my way through the garage I observed a large amount of what appeared to be blood on the
ground leading up to the interior door and stopping. Once inside the residence, I did not observe any blood.
Upon clearing inside of the residence I was met with one locked door secured by dead bolt. Upon clearing
with Sgt. Staner I forced entry into the door by kicking it open and cleared the room. After clearing the
residence by making sure nobody else was inside, we all exited the residence. While we were standing near
the garage I was observing radio traffic coming from inside the vehicle where Brandon Stansel was in, but
could not locate where it was coming from. To the best of my knowledge other than removing the hand gun

from Brandon Stansel none of the Deputies or Officers touched anything from the vehicle. As I was hearing
the echo coming from the car, I also heard that conversation that was not over the radio was coming from the
car as well. It was unknown what the source was, possibly a phone call that was not hung up between
Brandon Stansel and Kelly Brumley.
As EMS was cleared to come in to check Kelly Brumley and Brandon Stansel I walked back to the 1542 patrol
unit to pack the county issued rifle back into the supplied case and placed it in the truck portion of the patrol
unit where it is normally stored. At this time I observed Lt. Snelgrove to be on scene as well as Captain
Foreman and awaited further directions, which was to hold scene until the assigned investigators arrived.
While we were waiting for the investigators I was approached by Deputy Shane and was given a list of names
for the Deputies, Officers and EMS that were on scene. I was not given full names of EMS only last names
and possibly one first name only, Clute EMS unit 283 included Williams and Arrant unit 285 included Horsley
and Lindsey.
As Investigators Griffin, Sosa, Goolsby, and Thomas arrived scene was handed over to them and I was
requested to hold scene at the road to make sure no traffic gets through the area or any family that arrives get
on the scene. While holding scene, the father of Brandon Stansel was placed in the back of the 1542 patrol
unit for Investigators Sosa and Griffin to speak with until he was released. Richard Stansel the brother of
Brandon Stansel arrived on scene and I spoke with him briefly in regards to him wanting to know the status of
his father and brother, and what had happened. I told Richard Stansel that his father was not harmed in any
of the shooting and that he was safe awaiting for Investigators to speak with him and that I could not release
any other information. Richard Stansel was upset but understood protocol. As I was speaking with Richard
Stansel he was asking if the Officer involved was injured and stated that " I know my brother was guilty this
was a long time coming, I`m surprised it has taken this long". " He is a drug dealer and is always running
around with other drug dealers and has been supplying my mom with meth for several months". " the first
thing my dad said when he called me was; it`s finally happening, Kelly is all shot up probably dead in the
driveway and Brandon is shot up in the garage probably dead". Richard Stansel further said that the week
prior Brandon Stansel had a pistol that was reported to have been supplied to him by Kelly Brumley described
as a 9 mm with camouflage grips, and that Brandon Stansel brags about selling drugs. I asked Richard
Stansel if he would be willing to write a statement in regards to what he told me, but was told that he would
not provide a written statement until he gets a status on his brother at which time he would write down
anything he knew about Brandon Stansels illegal activities. I told Richard Stansel to remain in the area just
not in the immediate scene and to wait for Investigator Griffin to speak with him to release the information as
it will be his scene and call to release the wanted information.
As I was relaying the information to Investigator Griffin I was told to wait until he gets a chance to go speak
with Richard Stansel and to catch as much of the conversation on audio as I can. I remained in the area until
Investigator Griffin spoke with Richard Stansel and kept the county issued audio equipment active while the
two were speaking at which point Richard Stansel agreed to give a written statement to Investigator Griffin.
Afterwards, I was released from the scene to make relief and have Deputy Boulter come back to the location
to hold scene at the road as I was previously instructed.
Statement collected from Richard Stansel by Investigator Griffin, and after Investigator Griffin spoke with the
Father whom I never spoke with or identified was released from the back of the 1542 patrol unit. Audio/ video
was initiated upon responding priority one from the sub station. Richwood PD agency assist case # 190156,
Angleton PD agency assist case # 2019001272, Oyster Creek PD agency assist case # 19-0143. See Deputy
Shane, Cleberg, Johnson, Yates, and Sgt. Staners supplements for further information.
