Davis #1933, was notified by Criminal Investigation Sergeant Clint Lobpries of an ambulance call. I was advised that CPR was in progress on an inmate from the Brazoria County jail and he was currently being transported to Angleton UTMB. Sgt. Lobpries requested that I respond to the jail. At approximately 1915 hours, I arrived at the Brazoria County Jail Male Booking area and made contact with Lieutenant Colton Edwards #1808 who advised me that inmate Pineda, Jorge Arturo (DOB: 06/09/1981) was found in a single-man cell unresponsive by Deputy Jaramie Jackson # 2135, while he was conducting a routine security scan of A-row. Lt. Edwards advised me that Pineda was housed in A1W cell, which is a single man cell. Lt. Edwards escorted me to A1W cell. I observed the door to A1W cell to be closed and secured, with red crime tape across the exterior of the cell door. The tape was attached to the door in such a way that the tape on the left side of the door frame would break if the door were opened. No entry was made into the cell until the Crime Scene Investigator arrived. Lt. Edwards advised me that he was in the process of downloading the security scan logs and the security footage from the cameras in that portion of the jail. I viewed one of the downloaded security footage from A-Row hallway, a synopsis of the footage is as follows: The footage documented Deputy J. Jackson conducting a security scan at approximately 1732 hours. Deputy Jackson is observed opening the small metal door on A1W cell. He is observed looking into the viewing window and can be observed standing, looking into the cell for a few seconds. He then runs to the male booking area and returns to A1W cell, speedily with several deputies running behind him. The doors of the cell open, and several jail deputies enter the cell. Additional deputies, a video camera, and medical staff arrive and make entry into the cell. I learned from Lt. Edwards that deputies preformed life saving measures on the unresponsive inmate until medical staff arrived. EMS notified and responded to the jail. 1. On May 5th, 2025, at approximately 1812 hours, I, Investigator C. Davis #1933 (Unit 1523), was the on-call investigator for the South District of Brazoria County. I was contacted by Criminal Investigation Sergeant Clint Custodial Death Report :: Page 6 of 12 --- PAGE BREAK --- Lobpries in reference to an ambulance call. I was advised by Sgt. Lobpries that CPR was in progress on an inmate from the Brazoria County jail and he was currently being transported to Angleton UTMB. Sgt. Lobpries requested that I respond to the jail and make contact with Texas Ranger Aaron Arizmendi, who was also notified of the call. 2. A-row is an area within the jail that consists of all single-man cells. When I arrived, Lt. Edwards escorted me to the back side of A-row, adjacent to the male booking area, to A1W cell (door #123). I observed the door to A1W cell to be closed and secured, with red crime tape across the exterior of the cell door. The tape was attached to the door in such a way that the tape on the left side of the door frame would break if the door were opened. There were no other documents attached to the door, but I observed a spit hood placed through the door handle. No entry was made into the cell until the Crime Scene Investigator arrived. 3. After viewing the exterior of A1W cell, I walked to Lt. Edwards` office, where he provided me with two (2) half sheets of handwritten time logs that were signed by Deputy David Duffy #1185 and Deputy Rolando Sanchez #2054. I was advised by Lt. Edwards that Deputy Duffy started the time log when he arrived at A1W cell to assist with this incident. I observed this handwritten log to read as follows: "1750 CPR started". "1751 Gregory, Jackson, Trigg, Edwards "1752 CPR started" "1753 EMS en route" 4. Due to the shift change, Deputy Sanchez continued the time log. I observed this handwritten log to read as follows: "1754 CPR started." "1756 Gregory and Lozano switched." "1757 CPR started." "1759 CPR started; Lozano and nurse switched." "1802 CPR started." "1803 EMS arrived at Sally port." "1804 Put on board; CPS started." "1805 EMS at A1W tank; EMS in tank." "1807 CPR started; inmate placed on stretcher." "1808 CPR continued by Villarreal" "1809 CPR continued by Villarreal" "1810 Inmate in ambulance." "1812 Lucas 3 started, automatic CPR machine." "1815 Deputy Richard riding with inmate in ambulance" "1819 Ambulance departed en route to hospital." 5. While in the office, Lt. Edwards also provided me with a handwritten log labeled Central that documented the arrival and departure of EMS. I observed this handwritten log to read as follows: "1752 EMS contacted" "1803 EMS arrived" "1805 EMS entered jail" "1807 Crime Scene and Capt. Williams arrived" "1811 Inmate placed in Ambulance" "1820 EMS departed" 6. On the back of one of the handwritten logs, I observed instructions on escorting procedures that read: "Pineda, Jorge # 137092" " Camera and Supervisor for all movements " 2 Man Escort W/ Hand and Leg Restraints " Spit Hood " No Tablet " Styrofoam Only (highlighted) Per Sgt. Cornejo. (The documents were later submitted to ID as evidence.) 7. Lt. Edwards also provided me with a printout of Pineda`s booking sheet that documented that Pineda, Jorge was arrested on 12/01/2024 by Pearland Police Department for Aggravated Assault Against Public Servant (Cause# FJ055357, JP 3-2), Aggravated Assault Against Public Servant (Cause# FJ055358, JP 3-2), Aggravated Assault Against Public Servant (Cause# FJ055359, JP 3-2), Aggravated Assault Against Public Custodial Death Report :: Page 7 of 12 --- PAGE BREAK --- Servant (Cause# FJ055360, JP 3-2), CT-1/SS/Aggravated Assault-Enhanced (Cause# 101816-CR-1, 149th DC) and CT-2/SS/Unlawful Possession of a Firearm by Felon (Cause# 101816-CR-1, 149th DC). I observed the address listed for Pineda to be 8908 Sonia Ln., in Rosharon, TX 77583. I observed that Pineda`s place of birth listed as Houston and his next of kin to be his father, Armando Pineda. 8. 9. After reviewing the footage, I made contact with Jail Captain Wayne Williams, who advised me that Pineda was confirmed deceased at 1836 hours by the ER Doctor at UTMB Angleton-Danbury ER. Texas Ranger Arizmendi and the Forensic Investigative Unit (FIU), Investigator Minshew were leaving the Hospital and were en route to the jail. I remained in the jail and waited for their arrival. 10. I returned to Lt. Edwards` office, at which time he received a phone call from a female, who was later identified as Carolina Pineda (DOB: 01-27-85), requesting information on Pineda. I could hear the conversation through the phone, and Carolina Pineda was upset about the information she observed online and wanted to know what was going on. I advised Lt. Edward to get her name and number and to advise her that an investigator would return her call with information on Pineda, once the information was obtained. 11. When Lt. Edwards completed the call, he advised me that Pineda, Jorge, was booked out of the jail at 1720 hours, with the disposition as a death in custody. The investigation into Pineda`s death was in its initial stage, and not much information was known at that time. However, once Pineda was booked out of the system, his status was automatically updated online, and the family of Pineda was made aware of his passing. After learning that Pineda`s status was updated online by Lt. Edwards, I immediately went to the medical department to see if information could be released to Carolina Pineda. I learned that a release of information form was signed by Pineda on 2/12/25, authorizing the release of information to Carolina Pineda, his wife. I returned to Lt. Edwards` office and made notification over the phone of Pineda`s passing to his next of kin, Carolina Pineda. 12. At approximately 2102 hours, Texas Ranger Arizmendi, FIU Investigator Minshew, and Judge Sebesta arrived at the jail. We all walked to A-Row, A1W cell, where Investigator Minshew took his initial photographs of the exterior of the cell. The exterior metal viewing door was closed, and I observed a white sign on the exterior of the metal viewing door that read "Do Not Enter." Taped to the bottom of the viewing window I observed a white "Segregation Observation Sheet" on the door that showed the name of the inmate to be "Pineda, Jorge", his S.O. # "137092", and his "DATE IN: ". I observed that this "Segregation Observation Sheet" acted as a daily calendar for May 2025 in which the date and time were logged for when breakfast, lunch, and dinner were served to Pineda, and a Deputy would sign or initial when each meal was served. The log documented that Pineda refused his dinner meal at 1500 hours on 05/05/2025. Underneath the Segregation Observation Sheet, I observed a red box to be secured to the metal cell door, under the viewing window, which I learned was used to log the electronic scans that are conducted at each segregation cell every 20 minutes. 13. At approximately 2119 hours, A1W cell doors were opened and Investigator Minshew entered the cell to photograph and process the cell. After taking photographs, FIU Investigator Minshew assisted Texas Ranger Arizmendi with taking measurements of the interior of the cell. 14. When the cell doors opened, I was able to see the entirety of the cell, and I observed A1W cell to be a single-man cell with a metal cell door being the only point of entry into the cell. Inside this cell, I observed a single bed against the left wall as you enter this cell. I observed that this bed is a low metal bunk with an attached metal desk with a stool on the portion of the bed frame closest to the cell door. The bed/desk is bolted to the floor to prevent it from being moved around inside the cell. At the far end of this cell, against the wall furthest from the cell door, I observed a metal combination toilet/sink bolted to the wall and floor. On the wall above the toilet/sink, I observed a small mirror, an electrical socket, and an intercom. In the far-left corner of this cell, I observed a concrete wall that separated the shower area from the rest of the cell. I observed that this concrete shower wall did not extend up to the ceiling, leaving a gap of approximately 2 feet between the top of the wall and the ceiling. I observed that the opening to enter the shower area was toward the toilet to prevent anyone from looking into the shower area from the cell door. I observed a small shelf attached to the wall on the left side of the cell, mounted between the bed and the shower wall. I observed what appeared to be brown and white BCSO-issued towels to be thighed together to form a loop/circle. I observed the thighed towels hung over the mounted shelf. I observed the cell to have items sprawled on the floor of the cell. I observed orange BCSO-issued clothing on the bed alongside an automated external defibrillator (AED) and a cervical collar on the mattress of the bed. I observed a Styrofoam tray containing miscellaneous food items, a bag of chips, two sandwiches, and two cups on the metal table. I observed chip bags, empty soap boxes, and Custodial Death Report :: Page 8 of 12 --- PAGE BREAK --- other miscellaneous items. Items scattered around the cell to include a pile of orange BCSO-issued clothes on the floor near the base of the metal stool. I observed a large amount of commissary items and hygiene items underneath the bed. I observed yellow legal-size papers on the floor of the cell that were written on, and BCSO jail rules on the floor of the cell. (Writings were collected as evidence.) 15. After all evidence requested by Texas Ranger Arizmendi was collected from the cell by FIU, Investigator Minshew, the cell was again secured and released to the jail staff so that they could clean the cell before putting it back in use. 16. Contact was made with Lt. Edwards about conducting interviews with the Deputies involved in this incident. Interviews were conducted by Texas Ranger Arizmendi in the Lieutenant`s office, and I was present for the interviews. The following Deputies were interviewed: Deputy David Duffey #1185, Deputy Jaramine Jackson #2135, Lt. Colton Edwards #1808, Deputy Paul Villarreal #2172, Deputy Jonha Richard #1028, Deputy Sergio Mata #1877, Deputy Trigg # 2127; Deputy Howell #2170; Deputy Lozano #2202; Deputy Gregory #1402. Due to the incident occurring during shift change, some of the jail staff left for the evening. Texas Ranger Arizmendi advised that he would follow up with the other jail staff involved in this incident at a later time. Lt. Edwards provided me with a copy of the written statements obtained from the above Deputies, and they were added to this case in RMS as attachments. 17. Deputy David Duffey stated verbally and in a written statement: "I am a certified master jailer and have been a certified jailer for approximately 21 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 21 years. I am currently assigned as a Jailer in the BCSO detention center. On 05/5/2025, I, Deputy Duffey, was working day shift, 6:00 pm to 6:00 am, in the BCSO Jail. At approximately 1750hrs., I, Deputy Duffey, was conducting a count for the shift when I saw Deputy Jackson come running from the A1 side of A-row, stating he needed a camera and supervisor to A1W cell. He grabbed a hand-held radio and made the call for both over the air at approximately 1751 hrs. I, along with Deputies Trigg, Jackson, and Howell, ran to cell A1W, where I observed the cell to be housing inmate Pineda, Jorge SO# 137092. Central control opened the cell door A1W, and I quickly observed that inmate Pineda had some sort of sheet material tied around the shelf attached to the wall and around his neck. I started asking for a sheet of paper to initiate a timeline and eventually took the paper that was taped to the cell. I took a few notes before passing the list off to Deputy Sanchez so that I could return to the booking area and retrieve the guardian scanner so that the cell checks on A-Row could be completed. This would conclude my interaction with this event. End of report." 18. Deputy Jaramine Jackson stated verbally and in a written statement: "I am a certified jailer and have been a certified jailer for approximately 3 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 3 years. I am currently assigned as a Jailer in the BCSO detention center. On 5/5/2025 at 1747, I deputy Jackson so2135 was making relief for the day shift. I started to scan the back end of A-row. When I arrived at cell A-W, I saw inmate Pineda, Jorge, so#137092 hanging by his neck from some strung together cloth and towels. I immediately ran back to booking, grabbing a radio and calling for a camera, Supervisor, and medical to the back side of A-row, A1W cell at 1750. I had several deputies running behind me as I called for cell number 123 over the radio to be opened. I opened the door and saw deputy Lozano, so2202, make entry, followed by deputy Trigg, so2127, and followed by deputy Gregory, so1402. I then proceeded behind them. I noticed inmate Pineda was hanging by his neck in a kneeling position from the shelf on the left wall with his face towards the wall. Lozano grabbed his right arm while Gregory grabbed his left. Myself and Trigg got hold of his legs as we laid him on his back with his head towards the open door of the cell. Deputy Gregory immediately started chest compressions at 1751. Nurse Stephanie arrived on the scene along with several other deputies. Cutters were used to cut open Pineda`s shirt so the AED pads could go on his chest. Gregory continued chest compressions while Deputy Villarreal so2172 was on the AMBU bag, trying to get oxygen to inmate Pineda. Myself and Trigg were on standby. Deputy Lozano took over for Deputy Gregory on chest compressions while following directions from medical staff. EMS arrived around 1810 and got to cell A1W. The AED machine was removed from Pineda`s chest so the EMS personnel could put it on their system. Chest compressions were still ongoing with Deputy Villarreal as the inmate was moved to the stretcher and then placed on the gurney. Inmate Pineda was moved to the Ambulance in the Sally-port. Deputy Villarreal is still on compressions. I then stepped away and walked back into the jail, ending my involvement with this incident. End of Report." 19. Lt. Colton Edwards stated verbally and in a written statement: "I am a certified master jailer and have been a certified jailer for approximately 10 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 10 years. I am currently assigned as a Detention Lieutenant. On 5/5/25 at approximately 1750, I- Lt C Edwards entered the Lieutenant`s office just after completing the shift briefing. I heard an urgent call over the radio. I did not understand what was said on the radio, but I glanced up and viewed the camera system in the office. I saw Deputies running to the backside of A row. I immediately went to that area and saw Deputies entering cell A1W. Upon my entry, I observed an inmate on the floor in the cell and Deputies attempting to check on him. I observed what appeared to be ligature marks on his neck, so I assumed the inmate had attempted suicide by hanging. Medical staff entered seconds later, and I assisted by getting equipment out and prepared. Deputies started chest compressions and cut off the inmate`s shirt. Medical staff applied the pads, and Deputies began following the prompts of the device. I observed chest compressions and recovery breaths performed by BCSO staff and medical staff. After a moment, I stepped Custodial Death Report :: Page 9 of 12 --- PAGE BREAK --- up onto the bunk to make room, I ordered the staff in the area to avoid moving or touching anything in the cell unless necessary. I then exited the cell as medical, and Deputies continued life-saving measures. I contacted Captain Williams. EMS had been contacted at this time. I returned to the area and observed continued CPR being performed. EMS arrived on scene, and I observed staff assist in moving the inmate to the stretcher and continue CPR. I observed as the team moved to the sally port and boarded the ambulance. I stepped away to prepare for making transport in case the Deputy assigned was not prepared in time. I arrived back at the ambulance and observed medical staff beginning an automated compression device. Once the Deputy assigned for transport arrived, I left the area. The ambulance exited the sally port in route to the hospital. End of Report." 20. Deputy Paul Villarreal stated verbally and in a written statement: "I am a certified jailer and have been a certified jailer for approximately 2 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 3 years. I am currently assigned as a Jailer in the BCSO detention center. On 05/05/2025 at approximately 1750, I, Deputy Villarreal, was conducting a Head count scan along the front side of A row at the Brazoria County Detention Center, when I witnessed Sgt Jasso and Sgt Rhoads exit the sergeant`s office. I heard Sgt Jasso mention a suicide on the back side of A row. I rushed to the back side and witnessed other deputies entering a cell later identified as A-1W. Upon my entry, I witnessed other deputies removing an inmate, later identified as Inmate Pineda, Jorge SO 137092, from the wall between the bed frame and shower stall. I assisted deputies in placing Inmate Pineda on the floor. I was positioned between Inmate Pineda and the bed bunk once I and other deputies placed him on the floor. 21. Deputy Gregory was positioned opposite of me and began chest compressions. A moment later, medical staff arrived, Deputy Gregory stopped chest compressions, and cut Inmate Pineda`s thermal shirt off so that AED pads could be placed on his chest. I placed one of the AED pads on Inmate Pineda`s chest. I was also handed the AMBU bag and started with two breaths after Deputy Gregory`s 30 chest compressions that Nurse Stephanie was counting out. I, in concert with Deputy Gregory and nurse Stephanie, continued chest compressions and breaths for approximately 4 cycles of the AED. After the 4th cycle, Deputy Gregory was instructed to switch out. I instructed Deputy Lozano to continue chest compressions. Deputy Lazano continued chest compressions for approximately 2 cycles of the AED. It was at this point that Nurse Stephanie adjusted the AED pads on Inmate Pineda`s chest and took the spot opposite of me and continued chest compressions. Deputy Gregory took control of the AMBU bag while I lifted Inmate Pineda`s head to assist with air flow. After one cycle of the AED evaluation, I and other deputies placed Inmate Pineda on a back board. Once on the back board, I continued chest compressions until EMS arrived. EMS made entry and began to set up their equipment. I continued chest compressions throughout this time. Other deputies and I were then instructed to lift Inmate Pineda and place him on the stretcher outside the cell. 22. Once on the stretcher I continued chest compressions until the stretcher started moving. I then surrendered chest compressions to the EMT while assisting with the stretcher to the sallyport. Once in the sally port I was instructed by Sgt Rhoads to ride with Inmate Pineda to the hospital. I entered the ambulance and continued chest compressions as EMS personal positioned their equipment to continue chest compressions and air breaths. 23. I was then advised by Sgt Jasso that Lt Edwards was getting ready to ride along with me to the hospital unless Deputy Richard was ready before the mbulance left. Someone handed me medical paperwork to accompany Inmate Pineda to the hospital. I stood in the ambulance as EMT personnel continued with their life-saving measures for an unknown amount of time until I saw Deputy Richard outside the rear of the ambulance. I exited the Ambulance, and handed Deputy Richard the documents that had been given to me, and made my way back into the jail, thus ending my involvement in the incident. End of report." 24. Deputy Jonha Richard stated verbally and in a written statement: "I am a certified intermediate jailer and have been a certified jailer for approximately 25 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 25 years. I am currently assigned as a Jailer in the BCSO detention center. On 05/05/2025, I, Deputy Richard, was contacted by radio at approximately 1800hrs by Sgt Rhodes to report to the Sergeant`s office. I grabbed my belongings and reported as requested. When I arrived at the office, Sgt Rhodes said to get my gear and ride in the ambulance with the inmate Pineda, Jorge 137092. After grabbing my gear and driving around the facility. At 1815hrs, the inmate was already in the ambulance with CPR in progress. Deputy Mata (1877) was operating the video camera. Deputy Sanchez (2054) was maintaining an incident log at which time I officially took over. At 1820hrs, the ambulance left the BCSO facility en route to UTMB Angleton with CPR in progress. At 1824hrs, the medics administered "Epi" to the inmate`s IV, and CPR continued. At 1829hrs, the medics administered a second dose of "Epi" to the IV as CPR continued. At 18:30 hours, the medics attempted to take a blood pressure, and I have no idea of the result. At 1831, the ambulance arrived at UTMB Angleton as CPR continued. At 1833 inmate was placed in the ER room Trauma 10, where CPR continued. At 1836hrs the ER Doctor pronounced the inmate deceased. I then called the Jail Captain and stated that the inmate was pronounced dead. Captain Williams stated that they had already contacted the necessary people to finish the processing of the incident. At 18:38 hours, the ER staff began to disconnect the monitors and equipment from the inmate and covered him with a sheet. At 1900hrs Texas Ranger Arizmende arrived. End of report." 25. Deputy Sergio Mata stated verbally and in a written statement: "I am a certified jailer and have been a Custodial Death Report :: Page 10 of 12 --- PAGE BREAK --- certified jailer for approximately 7 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 7 years. I am currently assigned as a Jailer in the BCSO detention center. On 05/05/2025, I, Deputy Mata, was the camera operator for an incident that occurred on the back side of A-row at approximately 1750hrs. When I started filming the incident, Deputy Gregory SO # 1402 was in the process of administering chest compression on Inmate Pineda, Jorge SO #137092, A1W, in the direction of the AED. Deputy Lozano SO#2202 relieved Deputy Gregory in continuing to administer chest compressions in the direction of Nurse Stephanie. Nurse Stephanie shortly relieved Deputy Lozano in continuing to administer chest compressions until EMS arrived. As soon as EMS arrived, inmate Pineda was placed on the back board to be placed on the stretcher. EMS entered the cell and once they placed lifesaving equipment on him. He was placed on the stretcher. EMS continued to perform chest compressions while escorting him to the ambulance. Deputy Villarreal SO #2172 also assisted EMS in performing chest compressions. The ambulance left shortly from the Sally Port to UTMB Hospital. Deputy Richard rode in the ambulance. End of report." 26. Deputy William Trigg stated verbally and in a written statement: " I am a certified jailer and have been a certified jailer for approximately 6 years. I have been employed by the Brazoria County Sheriff`s Office for approximately 6 years. I am currently assigned as a Jailer in the BCSO detention center. On 05/05/2025, I, Deputy Trigg, was assigned to Booking at the Brazoria County Jail Facility. At approximately 17:50 hours, as I was making relief in booking and logging into the computer, Deputy J. Jackson (#2135) came running from the back side of A-ROW while paging for medical, camera, and supervisor immediately to the back side of A-ROW and then ran back to the back side of A-ROW. I immediately followed Deputy Jackson along with a few other deputies behind me. As we arrived at the cell, Deputy Jackson called for the door to A1W to be opened immediately. As the door opened, I saw the inmate, later identified as Inmate Pineda, Jorge (so-137092), hanging by a towel twisted around his neck hanging from a metal shelf between the bunk and shower petition. A few deputies and I ran in and lifted the inmate up enough to get the towel from around his neck, then we moved him to an open spot on the floor and his back so we could start chest compressions immediately. Deputy Gregory (#1402) started with chest compressions as medical and supervision arrived. Medical staff started setting up the A.E.D. and placing the shock pads on the inmate. CPR was continued the whole time as the AED device, instructed by Deputy Gregory and Deputy Villarreal (#2172), was pumping air into the inmate. As CPR was continued, we were able to slide the back board under the inmate. Deputy Lozano (#2202) took over chest compressions. Then Medical Nurse Stephanie took over chest compressions. I was standing by in case I was needed to take over for chest compressions. Then Deputy Villarreal took over chest compressions as EMS arrived, CPR was continued as EMS made their connections that were needed. When EMS was ready, we lifted the inmate and moved him out of the cell onto the EMS stretcher. CPR continued as the inmate was being strapped to the stretcher. While CPR was continued, I assisted with rolling the inmate on the stretcher out to the sally port to the ambulance and loaded the inmate into the ambulance. EMS then took over in the ambulance. That was all of my involvement with this incident. End of report." 27.
