A deputy arrived at the facility and executed the warrant on the subject. The facility determined that the subject be transported via EMS to a facility located in Harlingen. Prior to entering the ambulance the subject became non-compliant and refused to be transported. The EMS crew contacted the sheriff's office to assist. Deputies arrived on scene and used verbal intervention to get the subject to comply but to no avail. The subject's step father attempted to persuade the subject to comply, but the subject refused. The subject laid down in the bed of the pick-up and refused the transport. Subject became verbal and threatened to assault the deputies. Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- The EMS unit that was on location for the transport, left the parking lot to switch to an all-male crew due to the actions of the subject. After several verbal communication attempts to have the subject comply for the transport, deputies decided that the transport may have to be done by deputies utilizing a patrol car. The subject was given another opportunity to comply but he refused. The deputies then attempted to place the subject in hand restraints, in which a struggle ensued. The subject resisted and struck one the deputies in the face. Chemical agents were used on the subject and after a brief struggle, deputies were able to secure the subject in hand restraints. The subject was escorted off the pick-up and into the rear of a Crown Victoria patrol car. Deputies contacted dispatch to have EMS decontaminate and medically assess the subject. The EMS unit arrives and assesses the subject. They decontaminate and medically clear the subject for transport. Deputies were informed that an alternate EMS crew was en route to their location to transport the subject to Harlingen. The deputies placed the subject back into the patrol car to await the arrival of the transport EMS unit. Once the transport EMS unit arrived, deputies and the EMS personnel noticed that the subject was unresponsive in the rear of the patrol car. EMS began life saving measures and transported the subject to the local hospital. The medical staff at the hospital attempted to revive the subject, but it was unsuccessful. The subject was declared deceased by a Justice of the Peace and an autopsy was ordered. Custodial Death Report :: Page 7 of 7
