Yes, mark which Under Restraint: restraint devices were used Type of restraint Type of Restraint: Handcuffs Summary of Incident Summary of How the Death Occurred: (max. 30,000 characters) Summary: On Tuesday, April 11, 2017 at approximately 2:15 a.m., Mission Police Officers were dispatched to Leos Drive Inn Store, located at 2201 W. Expressway 83, in reference to a male subject that was being highly aggressive towards the clerk at location. Upon arrival, the officers observed a male who was later identified as Hugo Lugo (DOB 08/31/80) behind the cash register area of the store. The officers observed LUGO to be yelling and pacing back and forth in the back counter area of the store. As the officers approached LUGO, they ordered him to lie on the floor, which LUGO initially complied. As the officers attempted to place handcuffs on LUGO, he proceeded to resist by pulling his arms away and pushing the officers. The officers continued in attempts to control LUGO but he repeatedly pushed away and kept kicking and rolling around on the floor preventing the officers from handcuffing him. After a few minutes the officers were able to take control of LUGO and handcuffed him. The officers escorted LUGO to the unit and placed him on the rear seat. As the officer transported LUGO to the Mission City Jail, Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- he continued to be aggressive by kicking at the police unit’s door and window. Once at the jail sally port area, the officers had to physically remove LUGO from the rear seat, by grabbing him from under his both arms. The officers proceeded to carry LUGO to one of the single inmate cells. As the officers were removing the handcuffs from LUGO; they noticed he was no longer moving or breathing. The officers immediately started administering CPR and the suspect was immediately transported to Mission Regional Hospital. Upon arrival at Mission Regional Hospital, the medical staff began to provide medical attention to him but to no avail. He was then pronounced dead at 3:25 a.m. Custodial Death Report :: Page 7 of 7
