Fannin, Luling, in response to a male subject that was on someone’s porch claiming that he was being chased and throwing rocks at non-existent people. When Officer William Hilt arrived at the scene he observed a male subject (later identified as Andrew Carmona), wearing shorts but no shirt or shoes who began running toward Hilt’s patrol unit. When Hilt put his vehicle in park the doors unlocked and Carmona jumped into the backseat and closed the door. Hilt got Carmona out of the vehicle to pat him down for weapons. Hilt asked Carmona what his name was, Carmona stated it was Andrew Carmona and “I am in trouble sir”, and sat back inside the vehicle. Carmona stated that he was “in trouble for all types of shit” and he “didn’t take nothing man; I got people after me”. Carmona’s sister, Mary Carmona, arrived on the scene by vehicle and was interviewed by Officer Jon Bullard who had also arrived on the scene. Mary Carmona stated that her mother had called her and told her that Andrew said that people were after him and left her residence on Cummings. Both patrol units and Mary Carmona proceeded to the residence of Carmona’s mother, Alice Larios. Bullard asked Larios if there was something going on with Andrew and she said that she didn’t know, but that he had been drinking all night. Carmona began struggling in the back of Hilt’s vehicle and his mother began speaking to him in an attempt to calm him down. Bullard opened the door and continued talking to Carmona in attempt to calm him down. Carmona continued being highly agitated and attempted to jerk away from Bullard and Hilt. Carmona continued to struggle and was placed on the ground to be handcuffed to keep him front hurting himself or Bullard and Hilt. When officers began to roll Carmona over to stand him up he was initially unresponsive and Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- Bullard requested EMS. They again tried to roll him over and he grabbed Bullard’s pants leg and began kicking. After getting the kicking to stop Bullard and Hilt began to roll Carmona back over and noticed that he had stopped breathing and was foaming at the mouth. Carmona was taken out of cuffs and Officers immediately began CPR. Caldwell County Sheriff’s office units arrived on the scene and applied an automated external defibrillator without success. Lockhart EMS began automated CPR and contacted a doctor on duty who gave orders for several injections and continued CPR without success. CPR was discontinued by medical order at 1607 hours. Justice of the Peace Precinct 1 Caldwell County, Judge Mathew Kiely arrived at the scene of the incident and pronounced Carmona dead as of 1607 hours. Kiely ordered Carmona’s body removed to Central Texas Autopsy and an autopsy to be conducted Dr. S. Dana. Caldwell County District Attorney Fred Weber was also on scene until Carmona’s body was removed. As Chief of Police I requested the assistance of Texas Ranger Billy Mims for an overview of the incident and subsequent investigation. Custodial Death Report :: Page 7 of 7
