The caller reported that a male armed with a baseball bat had attempted to assault the same security officer he assaulted earlier that day. Upon arriving at the location, a local strip center, the officers were unable to find the male. They contacted the Custodial Death Report :: Page 6 of 7 --- PAGE BREAK --- individual who reported the incident to gather more details and descriptions of the suspect. While patrolling the area, the officers spotted the decedent, identified as Albizo Rodriguez, who was carrying a metal baseball bat. The officers tried to detain Decedent Rodriguez, repeatedly telling him to stop and put the baseball bat on the ground. However, he refused to follow their commands and continued to walk away quickly. During this time, Decedent Rodriguez turned toward the officers several times while holding the baseball bat above his head as if to swing and strike the officers. Officers discharged their tasers multiple times at Decedent Rodriguez, but the devices were ineffective. Later, Decedent Rodriguez picked up a large piece of broken concrete with his right hand while still holding the metal baseball bat in his left hand. He then stepped toward one of the officers, adopting a throwing stance by positioning his arm and hand that held the concrete behind him as if to throw it at the officer. In response, the officer discharged his duty weapon striking the decedent. Decedent Rodriguez succumbed to his injuries on the scene. The Houston Fire Department gave the time of death as 1616 hours. The Harris County Medical Examiner stated the manner of death was Homicide, and the cause of death was Mutiple Gunshot Wounds. Custodial Death Report :: Page 7 of 7
