Summary of Incident
Summary of How the Death Occurred: (max. 30,000 characters)
Summary:
On 5/13/2021 I, Officer A. Reed 173, responded to a pursuit of a vehicle traveling northbound. I was wearing
full department issued Patrol Officer uniform with police insignia clearly visible. Dispatch advised that the
vehicle was a red Dodge with a spoiler traveling north bound passing mm8 on I35W Dispatch also advised
that the occupants were murder suspects and that they had also just shot a Hill County Officer and were
armed in the pursuit, and this fact was also documented on the call card. Chief Anderson and I left the
Alvarado PD to stage for the vehicle at mm21 on I35W and prepare to use Stop Sticks to deflate the tires.
I arrived at mm21 and heard dispatch advise that the suspects were approaching mm17 and that they were

still shooting as they drove. I did not have Stop sticks in my Unit as they had been recently used to stop
another pursuit. Officer Givens did have stops sticks within his vehicle and he prepared to use them. I
provided cover for Officer Givens with Chief Anderson, Lt. Melson, and Cpl. Farmer due to the fact that the
suspects were reported to be shooting while driving. As they approached, I could see both suspects in the
vehicle. They dodged the Stop Sticks that Officer Givens deployed and continued north on I35W. As they
passed by, I observed that the rear window was broken out of the Suspect vehicle. I surmised the window
had been shot out by the suspects as they fired shots at pursuing law enforcement officers. This sequence of
events, along with the report of the suspects being wanted for murder and having shot a Hill County Officer,
led me to believe these suspects were dangerous, intent on escaping, and intent on inuring or killing police
officers. Their actions also created an extreme risk of injury or death to the public as they fled, shooting as
they fled.
I then got into my fully marked Alvarado patrol unit and joined into the pursuit behind the Grandview Unit. I
believe that I was the fourth unit in the pursuit. I was able to see the Grandview Unit with another unit in front
of him and a DPS unit. The Suspect vehicle was traveling North bound on I35. I observed the suspect vehicle
weaving from lane to lane as they drove at a high rate of speed around traffic. The Suspect vehicle passed
the 24 exit and the 26a exit. I then observed the driver take exit 27 at the last moment. I braked to allow the
Grandview unit to cross in front of me due to a vehicle that was in the roadway. The Suspect vehicle
continued North bound on the I35W frontage road.
The Suspect vehicle turned left at the 604 bridge and then another left to drive south on the I35W Frontage
road. The Suspect vehicle then passed the on ramp to get back onto I35W and stayed on the frontage road. I
heard over the radio authorization for the DPS Unit to engage in a PIT maneuver on the Suspect vehicle. At
this point I had positioned my patrol unit in the right lane while the suspect remained in the left lane. I was
now the fourth unit in the pursuit at this time and was able to see the DPS Unit move into the lane I was in
and accelerate to get into position for the PIT maneuver. I did not attempt to pass the Grandview Unit that I
was behind in case he was required to take evasive action from the PIT.
Both the DPS unit and suspect vehicle were traveling about 60 to 70mph and I could see that the Suspect
vehicle appeared to be accelerating, I observed the DPS Unit turn hard left into the Suspect vehicle`s back
right quarter panel. As the PIT was occurring, I observed both the Suspect vehicle and DPS Unit become
stuck together and begin to rotate. I began to rapidly slow my vehicle as the vehicles slid. I estimate the
vehicles slid for over 400 yards, from the initial impact. As they slid over this stretch of roadway, I could hear
shots being fired from the Suspect Vehicle as the two vehicles created smoke and debris as they slid. I
immediately called over the radio that shots were being fired. The Suspect vehicle then separated from the
DPS unit and slid to a stop in the right-hand ditch of the frontage road, as the DPS Unit slid backwards into
the left-hand ditch facing toward the Suspect Vehicle. I estimate they were about 40 feet away from each
other. I stopped around 50 yards back from the Suspect vehicle in the right lane. The suspect vehicle was
facing south, but its front end was slightly angled away from the frontage road. The DPS unit was facing the
suspect vehicle at a slight angle. At this point I was quickly getting my vehicle into park and opening my
driver`s side door. I was concerned about the safety of the DPS trooper as I witnessed shots being fired and
hitting the vehicle. Almost simultaneously, I began taking up my AR15 to engage the Suspects that were now
actively firing upon the DPS Unit.
I was able to see the glass on the driver`s side of the DPS Unit exploding into a white fog leaving distinct
bullet shaped holes in the glass that were highly concentrated on the driver`s side. Fearing for the life and
safety of the DPS trooper as well as the public as they were firing towards the highway, fearing for my life and
safety and well being for that of the other officers on the scene, and having no other options to stop the threat
the suspects posed as they fired at the DPS trooper, I believed I had to employ deadly force to stop the
threat. I then engaged the driver, which appeared to be firing upon the DPS Unit, with gun fire from my AR15.
As I fired, I could see the driver`s head in a crouched position as if taking low cover behind his door from
within his vehicle, and I could see his raised right arm for a few seconds. At this point I had not seen the
Passenger silhouette while I engaged with the driver. As I fired my AR15 I could still clearly see the DPS Unit
taking fire as more glass exploded into fog as rounds came from the Suspect Vehicle. The DPS Officer
appeared to be trapped and or injured within his Unit because I did not see him attempt to exit his vehicle to a
safer position, raising my concern for his life and safety. Based on the concentration of fire I was not able to
tell if the DPS Officer could effectively return fire upon the Suspects. I continued to engage the suspect
vehicle due continued fire coming from the suspect vehicle.
I then observed the Passenger silhouette for the first time, and it appeared he was taking a position to fire
from cover from with the vehicle. Again, fearing for the life and safety of the DPS trooper as well as the public
as they were firing towards the highway, fearing for my life and safety and well being for that of the other
officers on the scene, and having no other options to stop the threat the suspects posed as they fired at the
DPS trooper, I believed I had to employ deadly force to stop the threat the passenger now represented. As I
shifted my fire to the passenger, I lost sight of his silhouette and I could no long see him presenting a threat,
but I could still observe clouds of glass exploding from the driver`s side window of the DPS Unit were the DPS
Officer located. I then Switched back toward the driver of the vehicle, observing him to be in the same firing
position as earlier described, so I continued to fire at him in order to stop him from firing at the DPS trooper. I
observed that my rifle bolt had locked back. As I began to reload, I noted that my hearing was almost

--- PAGE BREAK ---
nonexistent, and I was not able to hear if any gun shots were still being fired. I looked toward the DPS Unit
and did not observe any more clouds of glass. I believed the threat had stopped, at least temporarily, so I
discontinued firing.
I then moved forward and took cover behind the Grandview unit that was in front of me in the left lane. I was
not able to see any movement within the vehicle that would indicate either occupant left their seated position.
I looked towards the DPS Unit and saw that he was now out of his unit, but I could not tell if he had sustained
any injuries.
Multiple Officers driving the Grandview Unit forward. We stopped and began to issue commands again. My
patrol unit was t driven forward by another Officer into the adjacent lane closer to the suspect vehicle. We
then moved forward with my Unit to obtain a better angle and view on the Suspect. I contacted dispatch to
have EMS stage in the area.
The passenger began to comply with commands and keep his hands visible, and exited the vehicle. He was
then walked back on the passenger side and secured. Due to the number of Officers at the front and rear of
my patrol unit I stepped away from the line to see if I could assist with medical. They had the passenger
laying behind another patrol unit that was safely away from the Suspect vehicle. I observed that another
Officer had a placed chest seal on the lower abdomen on the left side and that he was applying pressure to
the wounds. I checked the rest of his legs and body for any other injuries. I did not observe any other wounds.
I stepped back to allow the DPS Officer to continue to hold pressure and wait for medical to make the scene
when safe.
